What to Do If the At-Fault Driver Refuses to Provide Information?

By Matthew Willens  Aug. 28, 2015 9:46a

A car accident can be an extremely traumatic experience, and if the injuries and damage are serious the whole experience becomes particularly stressful. As if the physical suffering is not enough, the victim often has to struggle with medical bills, repair costs, and claims. To make matters worse, the other party involved in the accident may refuse to cooperate and not provide the information that you require to make a claim. They may out right deny having done anything. In such a situation, it is important that you follow the tips.

Remain Calm

Remember, an accident is a traumatic experience for both the victim and the other person. The other person also tends to stress out and may lose their ability to think clearly and rationally. So, rather than losing your calm and demanding information, you should stay composed and seek information in a calm and collected way.

You can always request the other person to cooperate rather than pressing him to divulge information. You must request some crucial information such as the license plate number of the vehicle, name of the driver, insurance details and contact information. The best way to collect information that you require is by taking photographs of both vehicles, and the accident scene. The photographs will provide you crucial information not just about the vehicle and accident, but also about the other person.

When collecting information on the accident scene, you should stay reserved and calm. Any of your statements can be used against you in the courtroom. It is important to understand that the other person is likely refusing to divulge information out of fear and not because of bad intentions. So, you must act in a way that makes the other person feel comfortable and not scared.

Do Not Try Investigating on Your Own

If the other person refuses to provide the information that you require, there is nothing much you can do. If you try to confront or force the other driver, it can act against you. Rather than pressing the other driver for information, you should stay alert and try to gather as much information as you can just by observing and listening to whatever he says. Note down everything that can help you identify the other person.

If the other person tries to intimidate you, do not confront them no matter how outraged you are. Instead, call up the police and let them investigate the matter and collect information.
