Understanding Whiplash Injuries in Car Accidents

One of the most common injuries sustained in a car accident can be one of the trickiest to get compensation for. That is because of the amount of proof that may be necessary. Whiplash is an internal injury, and insurance companies may be very reluctant to offer compensation for this. If you have suffered this painful injury because of someone else's negligence, however, then you still deserve compensation.

For many people, the idea of getting compensation for a whiplash injury brings to mind a person who put a neck brace on just before entering court, and then perhaps getting found out by suddenly turning around in response to a loud noise. While fake claims do get filed for any kind of injury, this does not take away from the fact that whiplash is real, and really painful. Whiplash covers injuries to the soft tissue along the neck, such as a strain or sprain, hyperextension, etc. This sort of injury is often the result of a rear-end accident, or a similar crash where the impact of the crash thrusts the driver forward and then violently throws them back. This means a violent back-and-forth motion for the head and neck too. This force is possible even in a seemingly minor accident.

One of the tricky aspects of a whiplash injury is that symptoms will often hide for a day or two, so that not even you are aware of the extent of your injuries. It is always a good idea to go to a doctor after a crash, because many serious injuries may go undetected for too long otherwise. One such injury is whiplash. After the adrenaline fades, do not ignore symptoms such as: headaches; a stiff, pained, or numb neck; dizziness; pain along the spine; lack of balance; and lack of focus.

Some whiplash injuries are more serious than others; a moderately severe case could possibly take several long and painful weeks to heal. But no matter how serious the damage, this is not an injury that can be picked up by an X-ray or even an MRI. That is why you really need a body of other medical records. With the documentation that you need in hand, here are several things you can establish in order to get the compensation that you deserve from insurance.

First of all, you need to be able to establish just how serious your whiplash is. This could be helped by showing that there are related injuries, such as serious cuts and bruises, or even broken bones. Then you can get a record of all the medical treatment you have needed, such as a trip to the emergency room, going to a physician or a specialist, etc. You really, really need medical records. Perhaps with the help of these records, you can give an estimate of how long recovery will take, whether this is a matter of weeks or months, or if perhaps you have sustained a permanent injury. Then you need to translate these injuries into your daily routine. How much does your soft tissue injury affect the way you work and participate in the activities compared to before the crash? And then of course, you need to establish liability for the accident.

For rear-end accidents, this can be simple; your task is easier if it is clear that the other driver broke a rule of traffic. But of course, not all cases are this straightforward. And even the clearest cut case does not guarantee that you will get the compensation you are owed. Whenever you need help preparing a claim and protecting yourself from insurance bad faith, a car accident lawyer can help you get the compensation that you fully deserve!
